Terms of service

1. Who we are

Kutavo is an online, AI-assisted video editing service published by Dylan Becerra, sole trader (entreprise individuelle), SIREN 952 822 633 (RCS Pau 952 822 633), VAT not applicable (article 293 B of the French General Tax Code), registered office at 64170 Lacq, France (“Kutavo”, “we”). 2. The service

Kutavo lets you, from a browser, have videos edited, subtitled, mixed, illustrated, cut into clips and published from written instructions. The result is produced by programs and artificial-intelligence models; it is proposed to the customer, who approves, corrects or rejects it before delivery. Kutavo does not guarantee that a result matches exactly an expectation expressed in natural language: the service is an assistant, and the customer remains the author of, and responsible for, their publications.

3. Account and access

The service is for adults; a minor may only subscribe with the consent of their legal representative. Access opens after subscribing to a plan. It is personal. The customer keeps their sign-in means private and informs us of any unauthorised use. We may suspend access in case of use contrary to these terms, after informing the customer.

4. Plans, prices and payment

Plans, prices and what they include are shown on the Pricing page. Prices are net of tax: French VAT is not applicable (article 293 B of the French General Tax Code). The subscription is monthly or yearly, as chosen at sign-up, renewed tacitly at each term (yearly: twelve months for the price of ten), and can be cancelled at any time from the customer's account (in the studio: Account, then “Cancel, invoices, payment method”, with confirmation); cancellation takes effect at the end of the current period. Moving up to a higher plan takes effect immediately: the price difference for the current period is charged, prorated, at the time of the change, and the change only happens if that payment succeeds. Moving down to a lower plan takes effect at the next renewal: the current plan remains available until then, with no refund of the difference. One email address carries only one active subscription at a time: a second subscription taken out with that address is cancelled as soon as it is created, and refunded if it has already been charged. Monthly counters reset every month on the anniversary of the subscription date, including for annual subscriptions.

Kutavo sells directly and issues the invoice. Card payments are processed by Stripe Payments Europe, Ltd., a payment service provider; Kutavo never stores card details. “KUTAVO” appears on the customer's bank statement.

5. Volumes and fair use

Each plan includes a monthly volume of footage (in hours), a number of edited videos and edits, and, depending on the plan, premium voice minutes and animated images. These counters are shown in the customer's account. Minutes of narrated gameplay depend on the plan. Wide technical limits (images analysed, texts written), sized for normal use, protect the service; the studio warns when they get close. The studio warns before starting a job that would exceed the remaining volume. Unused volumes do not carry over. The service also applies a monthly processing-cost ceiling per subscriber, set at 85% of the plan price: if it is reached before the counters, the studio says so and billable jobs resume at the monthly renewal, or straight away by moving up a plan. Clearly abusive or automated use (queues of jobs without human intervention, resale of capacity) may lead to a limitation after informing the customer.

6. Free trial

Each plan starts with a 48-hour trial with the same limited volume for every plan: twenty minutes of footage, two edited videos, two edits, two minutes of premium voice and one animated image; the plan's full volume opens with the first charge. A payment method is requested at sign-up; nothing is charged during the trial. One trial per person and per payment method: if the card or the email address has already been used for a Kutavo trial, the subscription starts at sign-up, with no trial period, as shown on the payment page. The customer may cancel during the trial from their account, at no cost; otherwise the subscription starts at the end of the 48 hours at the price of the chosen plan.

7. Customer content

The customer warrants that they hold the necessary rights over the videos, music, texts and images entrusted to the service, and that processing them infringes no third-party right. Kutavo acquires no right over this content nor over the results produced, which belong to the customer. Third-party archives, footage and images that the studio places in a video remain under their own licence (public domain, Creative Commons, stock-library licence): their author, source and licence ship with the video in a credits file, and the customer undertakes to honour them when publishing, in particular the attribution required by Creative Commons licences. Working files are kept for the time needed to process and retrieve the result, then deleted as described in the privacy policy. Customer content is not used to train models.

8. Prohibited content

Illegal, infringing or defamatory content, sexual content involving minors, content inciting hatred or violence, or content misleading as to the identity of a real person, is prohibited. We may refuse a job and close an account in case of breach. Voice cloning is only allowed for your own voice, or that of a person who gave written consent; the cloned voice is deleted when the subscription ends. When a video contains a voice or images made by the studio, the studio writes an “AI-generated content” label into the delivered file, adds it to the suggested description and ticks YouTube’s “altered or synthetic content” box when publishing from the studio. The customer keeps these labels, discloses AI-generated or AI-altered content where the platform requires it, and does not use the service to impersonate a real person without consent, to mislead, or to produce sexual or hateful content.

9. Availability and changes

We make our best efforts to keep the service available, without an absolute guarantee of continuity. Maintenance interruptions may occur. The service evolves: features may be added, changed or removed, without reducing the essence of what is sold during a paid period.

10. Liability

Kutavo is bound by a best-efforts obligation. Our liability, all causes combined, is limited to the amount paid by the customer over the last twelve months. We are not liable for indirect damages, for the consequences of a publication decided by the customer, or for unavailability attributable to a third party (host, payment platform, publishing service).

12. Personal data

The processing of personal data is described in the privacy policy.

13. Governing law

These terms are governed by French law. In case of dispute, the parties seek an amicable solution; a consumer may use the consumer mediator (details on written request to contact@kutavo.com). Failing that, French courts have jurisdiction.
